Senator Buehrer Introduces Ohio ACEP Legislation SB 86

On March 25, 2009 Senator Buehrer introduced SB 86 to grant qualified civil immunity to a physician who provides emergency medical services, first-aid treatment, or other emergency professional care in compliance with the federal Emergency Medical Treatment and Active Labor Act (EMTALA) or as a result of a disaster. The purpose of this bill is to provide appropriately limited liability for all physician emergency medical providers under EMTALA requirements, to encourage participation in emergency medical care, and to improve access to care and quality of emergency care for patients in the State of Ohio. This bill also proposes amending Ohio statute to provide new limited liability protection for physicians in disaster and emergency situations.

The bill will next go to the Senate Reference Committee to be assigned a Senate Committee. Our web site will be updated with the progress of the bill.
